Why this matters

Why a car accident lawyer changes what the insurer offers you

Most people walk away from a crash assuming the insurance company will sort it out. Sometimes it does. But the adjuster calling you within 48 hours does not work for you — they work for the driver who hit you, and their job is to close your file for as little as possible, as early as possible, before anyone knows how badly you were hurt.

That call usually comes before your first specialist appointment. It comes before you know whether the neck pain settles down in three weeks or turns into a year of physical therapy. Anything you sign at that point is final.

A car accident lawyer changes the arithmetic. They deal with the adjuster, they price the claim against what your injury actually costs over time, and they get paid only if they recover money for you. There is no cost to find out whether that is worth doing in your case.

Car accident lawyer, auto accident attorney, car wreck lawyer — same job

What people call the lawyer they need depends mostly on where they live. In Texas and across the South you will hear car wreck attorney. Insurers and court filings say motor vehicle accident lawyer. Search results are full of auto accident attorneys, automobile accident lawyers and car injury attorneys. Some firms describe the same work as personal injury lawyer, car accident, because a crash claim is one type of personal injury claim.

They all mean the same thing: a lawyer who sues the at-fault driver’s insurer on your behalf and takes a percentage only if they win. Whichever phrase you typed to get here, the free review below is the same.

Eligibility

Do you need a car accident lawyer? Start here

Broadly, you have a claim worth taking to a car accident attorney if all or most of these are true.

A car with front-end damage after a collision

Someone else was at fault, in whole or in part

You do not need to be blameless. Most states reduce your recovery by your share of the fault rather than barring it — being partly responsible is not the end of a claim, and you should not decide that for yourself based on what an adjuster told you.

You were hurt

Injuries that appear days later still count. Whiplash, concussion and back injuries very often do.

You have losses you can point to

Medical bills, missed shifts, a car you can’t drive, treatment you still need.

You are still inside your state’s filing deadline

In some states that is as little as one year. Check your deadline →

It happened on the road

Driver, passenger, pedestrian, cyclist, rideshare passenger — all of them can have a claim.

Cases we still want to hear about

Your situation
Why it may still be a claim
The other driver had no insurance
Your own uninsured or underinsured motorist coverage may pay — many people don’t know they have it.
It was a “minor” accident
Low vehicle damage does not mean low injury. Insurers argue that it does; that argument is beatable.
You were partly at fault
Comparative fault reduces a claim in most states rather than ending it.
You were working when it happened
You may have both a workers’ compensation claim and a claim against the at-fault driver.
It was a company or fleet vehicle
The employer may also be liable, which usually means a much larger policy.
Someone died
A wrongful death claim belongs to the family — see wrongful death claims.

Damages

What a car accident injury claim can cover

Two kinds of loss, and people routinely forget the second.

Medical bills, treatment notes and paperwork from an accident claim

Economic losses

The things with receipts
  • Emergency treatment, surgery, imaging, follow-ups
  • Physical therapy and rehabilitation
  • Medication and medical equipment
  • Care you will still need next year and the year after
  • Wages you have already lost
  • Earning capacity, if you can’t go back to the work you did
  • Vehicle repair or replacement, rental, towing

Non-economic losses

The things without receipts — often the bigger number
  • Physical pain
  • Emotional distress, anxiety about driving, sleep loss
  • Loss of enjoyment — the things you have stopped being able to do
  • Permanent scarring, disfigurement or disability
  • Strain on your marriage and family life

Punitive damages. A small number of cases involve conduct that was extreme — drunk driving, street racing, a fleeing driver. These are rare and are not available in every state.

How much are car accident claims worth?

There is no average worth quoting at you, and anyone who gives you a figure before seeing your medical records is guessing. Value turns on how badly you were hurt, how long recovery takes, how much fault is disputed, and — very often the real ceiling — the size of the at-fault driver’s insurance policy.

We have broken the ranges down properly, with the working shown, on a separate page.

First steps

What to do after a car accident — and when to call a lawyer

If the crash was recent, in this order. Step five is the point at which most people start looking for a car accident attorney.

Get checked by a doctor, today

Adrenaline hides injuries for a day or two. A gap between the crash and your first medical visit is the single most common thing insurers use to argue you weren’t really hurt.

Report it

Call the police and get the report number. Notify your own insurer that it happened — that is different from giving a recorded statement.

Photograph everything before the cars move

Both vehicles, all four angles, the road, skid marks, signals, weather, the other driver’s plate, licence and insurance card.

Get names and numbers of witnesses

They leave within minutes and are almost impossible to trace afterwards.

Don’t give the other insurer a recorded statement, and don’t accept a quick cheque

You are allowed to say you will respond after speaking with a lawyer. A first offer arriving inside a week is a sign the adjuster thinks the claim is worth more than they are offering.

Keep everything

Bills, discharge notes, prescriptions, mileage to appointments, and a note of days missed and what you couldn’t do at home.

State rules

Who pays after a car crash — at-fault vs no-fault states

This decides how your claim works, and it depends entirely on where the crash happened.

An insurance policy and claim paperwork under a magnifying glass
Most states

At-fault (tort) states

The driver who caused the crash, through their insurer, pays for your injuries and property damage. You claim against them.

Fault is therefore the whole battleground — and the percentage an adjuster assigns you in week one is an opening position, not a finding.

A doctor checking on a patient recovering in hospital
Around a dozen states

No-fault states

Your own personal injury protection (PIP) coverage pays your initial medical bills and some lost wages regardless of who caused it.

To claim against the at-fault driver for pain and suffering, you generally have to clear a threshold set by state law — a level of injury severity, or a dollar amount of medical costs. A few of these states also let drivers choose their system when they buy the policy.

Comparative fault

Most states cut your recovery by your percentage of blame. Some bar recovery entirely once you pass a set threshold. A small number still apply the old contributory-negligence rule, where any fault at all can end the claim.

Damage caps

Some states cap non-economic damages, particularly where a government vehicle is involved.

This is the whole reason to hire a car accident lawyer licensed in the state where the crash happened rather than simply the nearest one. A motor vehicle accident attorney who files in your county every week already knows which of these rules the defence will reach for.

Coverage

Car accident lawyers near you — browse by state

Searching for a “car accident lawyer near me” gets you whoever bought the biggest ad. What actually matters is that the attorney is licensed where the crash happened, because deadlines, fault rules and minimum coverage are all set state by state. Pick your state to see how car accident claims work there — or send the form and we’ll match you with a law firm that handles auto injury cases in your area.

Our standards

What makes the best car accident lawyer for your case

Every firm calls itself the best car accident attorney in town, which makes the phrase useless. Here is what we actually check before a car accident law firm receives anyone from us — and what you should check yourself, on any firm, including ones we never mentioned.

An attorney reviewing a case file with a client

Licence and discipline check

Active bar licence in every state they claim to serve, plus a public discipline search. An open suspension is disqualifying.

The right kind of experience

A firm that tries trucking cases every month is not automatically the right car accident lawyer for a low-speed rear-ender with disputed injuries. We match on what actually happened to you.

They pick up the phone

We track how long each firm takes to call a new claimant back. Firms that leave people waiting stop receiving cases.

A fee agreement in plain language

Percentage, case costs, and what happens if you lose — in writing, before you sign.

Use these on any firm, including one we didn’t send you. They are the same four questions we ask, and the top rated car accident attorneys answer all of them without hesitating. If a firm won’t put the fee terms in writing before you sign, that is your answer. Injury Case Claim is not a law firm and does not represent you — we connect you with the firms that do.

Fees

How much does a car accident lawyer cost?

Nothing up front, and nothing at all if you don’t win.

Car accident lawyers and auto accident attorneys almost always work on contingency: they take an agreed percentage of what they recover for you, typically in the region of a third, and if there is no recovery there is no attorney fee. You should never be asked for money up front by a car accident law firm.

Our service is free to you at every stage. We are not a law firm — the car accident lawyers in our network pay us when they take on a case we refer. That does not change the fee you agree with the firm, and it does not oblige you to hire anyone.

Signing a contingency fee agreement with a law firm

Ask every firm these two questions

What is the contingency percentage? And does it change if the case is filed in court or goes to trial? Many agreements step up at those points, which is normal — but you should know before you sign.
What happens to case costs if we lose? Filing fees, expert reports and medical records are separate from the attorney fee. Some firms absorb them if the case fails and some bill them back to you. This part varies between firms and it is the one people are surprised by.

Questions

Car accident lawyer FAQs

Do I need a lawyer for a car accident?
Not always. If nobody was hurt and the insurer is paying for the repair without argument, you may not need one. You probably should speak to one if you were injured, if fault is disputed, if the other driver was uninsured, if the first offer arrived suspiciously fast, or if you are still treating. The review is free, so the cost of finding out is nothing.
How much does a car accident lawyer cost?
Nothing up front. They work on contingency — a percentage of what they recover, and no attorney fee if they recover nothing. Ask specifically what happens to case costs if the case is lost.
How long do I have to file a car accident claim?
It depends on your state — commonly two or three years, as little as one in some, and only a few months’ notice where a government vehicle is involved. Check your deadline here.
What if the accident was partly my fault?
In most states you can still recover, reduced by your share of the blame. The rules differ significantly by state, and the percentage an adjuster assigns you early on is an opening position, not a finding.
What if the other driver had no insurance?
Your own uninsured or underinsured motorist coverage may cover it. Many drivers have this without realising. A lawyer can read your policy and tell you.
How much is my car accident claim worth?
It depends on your injuries, your treatment, your lost income, the disputed share of fault and the at-fault driver’s policy limits. We break the ranges down on average car accident settlement amounts.
How long does a car accident claim take?
Straightforward claims with clear fault and completed treatment can resolve in months. Disputed liability, serious injuries or a filed lawsuit can take a year or more. A firm should never encourage you to settle before your doctors know what your recovery looks like.
How do I find a good car accident lawyer near me?
Start with licensing, not with rankings. The attorney must be licensed in the state where the crash happened, and should handle car accident claims regularly rather than occasionally. Ask how many cases like yours they have resolved, who will actually handle your file day to day, and what their fee agreement says about case costs if you lose. Proximity matters less than people think — most car accident lawyers take cases across their whole state, and much of a claim is handled by phone and email.
What’s the difference between a car accident lawyer and a personal injury lawyer?
A car accident claim is one type of personal injury claim, so every car accident attorney is a personal injury lawyer — but not every personal injury lawyer spends much time on crashes. You want one who does. The terms auto accident attorney, car wreck lawyer, motor vehicle accident lawyer and automobile accident attorney all describe the same work; which one a firm uses is mostly regional.
Is Injury Case Claim a law firm?
No. We are a free connection service. We do not give legal advice and we do not represent you. No attorney-client relationship is created by submitting the form — that begins only when you sign an agreement with a firm, and you are never obliged to.

You Focus on Healing.
We’ll Handle the Rest.
