About the service

About the service

Is Injury Case Claim a law firm?
No. We are a free connection service. We do not give legal advice and we do not represent you. No attorney-client relationship is created by submitting the form — that begins only when you sign an agreement with a firm, and you are never obliged to.
What does it cost me?
Nothing, at any stage. There is no charge to use the form, to speak to a specialist, or to be introduced to a firm. The lawyers in our network work on contingency — no fee unless they win.
How are you paid, then?
The law firms in our network pay us when they take on a case we refer. That does not change the fee you agree with your firm and it does not add anything to your costs. Full explanation here.
Will my details be sold to a panel of law firms?
No. Your information goes to the claim specialist who reviews it and to the one firm we introduce you to. See the privacy policy for the detail.
Do I have to hire the firm you introduce me to?
No. The consultation is free and carries no obligation. Compare the fee agreement with anyone else you are considering before signing anything.
Whether you have a claim

Whether you have a claim

How do I know if I have a case?
Broadly, if someone else failed to take reasonable care, that failure injured you, you have losses you can point to, and you are still inside your state’s filing deadline. The free review exists to answer exactly this, including when the answer is no.
Can I claim if the accident was partly my fault?
In most states yes, with your recovery reduced by your share of the blame. The rules differ significantly by state and a few are much harsher. The percentage an adjuster assigns you early is an opening position, not a finding.
I already had a bad back, knee or shoulder. Does that rule me out?
No. Making an existing condition worse is compensable. Insurers lean hard on this, which is exactly why it needs a lawyer.
My claim was denied. Is that the end of it?
A denial is a position, not a ruling. Denials get reversed regularly once a lawyer assembles the medical evidence properly.
I’m on workers’ compensation. Can I still bring a claim?
Often, yes. Workers’ compensation usually bars you from suing your own employer, but not a third party who contributed — a contractor, a driver, an equipment manufacturer. That third-party claim is a full injury case with damages comp does not pay.
Deadlines and timing

Deadlines and timing

How long do I have to file?
It depends on your state and the type of claim — commonly two or three years, as little as one in some states, and only a few months’ formal notice where a government body is involved. Medical negligence and claims involving children often run differently again. Check your deadline.
It happened a while ago. Is it too late?
Possibly not. Most deadlines are measured in years, and some are extended where the injury was discovered late or the injured person was a child. It takes one short call to find out rather than assume.
Why does everyone say to call quickly?
Because evidence expires long before your filing deadline does. Shop and car park CCTV is commonly overwritten within one to four weeks, doorbell and dashcam footage within days, and a commercial carrier’s driver logs and vehicle data on retention schedules measured in months.
How long will my claim take?
Straightforward claims with clear fault and completed treatment can resolve in months. Disputed liability, catastrophic injury or a filed lawsuit can take a year or more.

How much is my case worth?
It depends on your injuries, your treatment, your lost income, the disputed share of fault and the policy limits behind whoever hurt you. Anyone quoting a figure before seeing your medical records is guessing. How claim value is calculated.
How much does a personal injury lawyer cost?
Nothing up front. They work on contingency — a percentage of what they recover, typically in the region of a third, and no attorney fee if they recover nothing. Ask specifically what happens to case costs if the case is lost.
What comes out of my settlement?
The contingency fee, the case costs the firm advanced, and any medical liens where an insurer or provider has a right to be reimbursed. Liens are the part people are least prepared for and they are often negotiable.
The insurer offered me money already. Should I take it?
Not before you know what your treatment will cost. A fast offer usually means the adjuster has worked out the claim is worth more than they are offering. Nothing is binding until you sign a release.
